The European Court of Justice today ruled that the gambling monopoly in Germany was “unjustifiable”, and required dismantling with immediate effect, according to the Bloomberg news agency.

The Luxembourg court heavily criticised Germany's perfectionist gambling sector, citing the monopoly as unsustainable. “The German rules do not limit games of chance in a consistent and systematic manner. In such circumstances, the preventative objective of that monopoly can no longer be pursued, so that the monopoly ceases to be justifiable.”

The Swiss Federal Council has upheld the ban on poker tournaments outside of casinos, it has been reported. World Radio Switzerland understands that the Supreme Court ruling in June that alleged poker was a game of luck and not skill will remain in place for the foreseeable future.

There had been hope that there would be a change in the law after a lower court stated that poker was a game of skill before the ruling two months ago, but the successful appeal by Swiss casinos after that ruling resulted in a ban that has been widely criticized by the International Federation of Poker.
