Online Poker is OK Intrastate says US Unlawful Internet Gambling Enforcement Act (UIGEA)

A surprising and little-tapped benefit of last year's Unlawful Internet Gambling Enforcement Act (UIGEA) is that state residents are allowed to participate in Internet gambling which is conducted within their state borders, casino attorneys say. This includes online poker too.

You may recall that the Unlawful Internet Gambling Enforcement Act (UIGEA) signed into law October 2006 made it unlawful for financial institutions to handle online gambling transactions from Americans.

In Nevada, Station Casinos has allowed registered customers using the company's intranet to make sports bets from their home computers, which Nevada allows.

Nevada's State Gaming Control Board has also already approved several companies to become licensed operators of mobile gambling devices in the state.

Those companies include: Cantor G& W, then later Game Technology (IGT), and most recently FortuNet. This follows from law AB 471 which permits mobile gambling in Nevada casinos that the State of Nevada passed in 2005.

But one expert says Nevada is not likely to press for rules allowing full-scale online wagering. "There's not enough money in it," Las Vegas attorney Tony Cabot said.

Cabot said that New Jersey, with more than four times Nevada's population, is a better bet.

New Jersey's top casino cop, Division of Gaming Enforcement Director Thomas Auriemma, says there is no great appetite for it in the Garden State, where he has discussed the prospect with gaming attorneys over the past five or so years.

"I don't see it happening at this point," Auriemma said.

New Jersey's constitution would probably have to be amended to allow Internet gambling, which would require approval in both legislative houses and a vote by the people.
