Bill to Study California Intrastate Online Poker Progresses

California Bill AB 2026 to study online poker within the US state of California was unanimously passed Wednesday by the Assembly Governmental Organization Committee (AGOC), sending the bill onwards to the Assembly Appropriations Committee, making its way forward towards an eventual vote.

The Bill, titled "The Gambling Control / California Intrastate Online Poker Act", was introduced Feb 15, 2008 by Assemblyman Lloyd Levine (D-Van Nuys), Chairman of the Assembly Utilities and Commerce Committee.

According to Capitol Weekly, the newspaper of California government and politics, Bill AB 2026 directs the California State Gambling Control Commission, in conjunction with the state Department of Justice, to perform a study regarding authorization of Internet poker for California residents, in accordance with the federal Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA), which stipulates that individual states have the right to legalize and regulate intrastate online gambling.

If the study is approved, conducted, and shows intrastate regulation is feasible, the bill could evolve and produce the appropriate language for intrastate poker legalization to be voted on in the future. Media reports say this could be presented to the California Legislature by June 30, 2009.

"It would be regulated," Levine said in the Capitol Weekly. "We don't know what the state's piece will be, but it will be a regulated entity."

Levine also believes regulated California online gambling would ensure consumer protection for Internet gamblers. For example, if a player is playing legally on a site that is legal in California, there is recourse if a site refuses to pay that customer.

The AGOC hearing on Wednesday heard supportive testimony from Poker Voters of America President Jim Tabilio, and from Rod Blonien, representing the card rooms of: Commerce Club, Garden City, Hollywood Park, Lucky Chances, the Lucky Derby, and the Lucky Lady.

Poker Voters of America has agreed to serve as the official citizen sponsor of the legislation, working with representatives of Assemblyman Levine's office, as well as representatives of the California Attorney General's Bureau of Gambling Control; the California Assembly Speaker's Office, the Office of the Senate President pro Tem, and other state officials to help expedite an agenda and timeline for consideration and passage of AB 2026.
