Deadline Passes for WTO Online Gambling Settlement Proposal from USAWed, Apr 2nd, 2008 @ 12:00am The end of March deadline for the US to put forward a proposal to settle the 5-year long online poker and Internet gambling dispute that Antigua and Barbuda filed with the World Trade Organization (WTO) passed with no word from the US Trade Representative's Office. Neither Mark Mendel, Antigua and Barbuda's attorney, or the local Directorate of Gaming had received any communication from US officials, the Antigua Sun newspaper reported.
The paper relayed that, "In a process that has seen many delays and missed deadlines, the apparent failure of the US to put forward a settlement proposal by the end of the month was apparently met with an air of resignation in Antigua and Barbuda, with officials continuing to adopt a "wait and see" approach to the protracted negotiations process." Mendel has made it clear that any proposal they agree on will cover the two separate issues involved in the dispute. The first issue is to address the United States' failure to comply with the World Trade Organization (WTO) ruling on access for Internet gaming operators. The second issue is Antigua and Barbuda's claim for compensation triggered by the US seeking to withdraw from its commitment to provide market access to the online gambling sector under the WTO General Agreement on Trade in Services (GATS). A WTO Dispute Settlement Body arbitrator awarded a US$21 million per year sanction against the US last December relative to the first issue. The ruling grants Antigua and Barbuda the right to ignore US copyright restrictions, which means Antigua can sidestep protections and distribute American music, movies and software, up to the value of the claim each year (click here for related article). The latter issue has yet to be settled. Mendel claimed in a previous interview with the Antigua Sun that the US had stopped efforts to negotiate on the issue in December 2007. So they filed a notice at the WTO at the end of January requesting arbitration on the issue (click here for related article). "Any settlement that we would do would be comprehensive. It would take in everything," Mendel explained in an earlier interview. "These are (two separate issues) if we have to litigate them, but if we can settle something then it should all be settled in one go." Read Related Articles:
