Dutch Banks Asked to Stop Serving Online Poker, Internet Gambling List

A Dutch Justice Ministry spokeswoman revealed that they are asking banks to join in the fight against illegal Internet gambling by stopping services to a list of online poker and online gambling companies located in other European Union countries, in a move reminiscent of the Unlawful Internet Gambling Enforcement Act (UIGEA) of the USA, though the action is not mandatory.

"It is illegal to offer gambling services in the Netherlands without a permit. These companies know they break the law," the spokeswoman said over the weekend.

Only the Dutch state lottery organization has a permit to offer online gambling in the Netherlands.

While the Dutch government is requesting help from banks located in the Netherlands, they know that the move will not completely block all transactions. "This is a Dutch issue, so we have only asked banks operating in the Netherlands to participate," said a spokeswoman for the Justice Ministry.

The Swedish online gambling companies Unibet and the independent Dutch firm Oranje Casino were confirmed amongst the firms targeted. But the spokewoman declined to identify any more of the 30-50 Internet gaming firms on the compiled list with which the government has asked banks to stop services.

The spokeswoman added that dossiers would be passed to the public prosecutor who would be tasked with bringing cases to court.

EC REACTION LIKELY TO COME

The announcement is likely to elicit a strong response from the European Commission (EC), who had already given a final warning to Holland in February, challenging their protectionist practices against foreign gambling operators, while attempting to bring them into compliance with EU directives that give EU-based operators the free movement of goods and services between the 27 EU member countries.

The next step the EC can take after issuing a final warning is to send the Dutch case to the European Court of Justice (ECJ).
