iMEGA Adds Top Attorney for UIGEA Appeal in U.S. Courts SeptemberMon, Sep 8th, 2008 @ 12:00am The advocacy group dedicated to the continued growth and innovation of the Internet, called Interactive Media Entertainment & Gaming Association (iMEGA), is continuing its challenge to the constitutionality of the Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA) that was passed to block online poker and Internet gambling. They just announced the addition of one of Washington DC's most accomplished attorneys to their legal team, Stephen A. Saltzburg, who is professor of law at George Washington University. Saltzburg has been working with iMEGA's legal team as it gets ready for its appeal case being heard by the US 3rd Circuit Court of Appeals. "Prof. Saltzburg is simply one of the best," said Joe Brennan Jr., Chairman and CEO of iMEGA in a press release on their site. "His experience speaks for itself. We are fortunate to have a true heavyweight advocate in our corner." Saltzburg joins lead counsel Eric M. Bernstein, noted First Amendment and Internet Law attorney, and Edward Leyden, iMEGA's president and chief counsel, as an integral part of iMEGA's legal team in its showdown over UIGEA with the U.S. Department of Justice. "We always had a strong team representing us," explained Brennan. "The addition of Prof. Saltzburg to our line-up demonstrates that iMEGA is serious about meeting the US Department of Justice on equal terms in court, and that we have strong advocates making a compelling argument as to why the court should overturn this troubling law." Saltzburg is a former deputy assistant attorney general in the Criminal Division of the U.S. Department of Justice, and chairman of the ABA Criminal Justice Section from 2007 to 2008. He joined GW Law in 1990, having formerly taught at the University of Virginia School of Law, and was named the 1st incumbent of the Class of 1962 Endowed Chair. Brenan recently spoke at the Next Generation in Gambling Conference in Montreal, where he commented that the UIGEA issue boils down to hypocrisy between being able to play poker (for example) in a casino, but not on your computer, saying: "You have a law that criminalizes an activity that's illegal online, but perfectly legal offline. The rights that we have as Americans should translate to the online world; there should be no inconsistencies. We should have the same rights online as we have offline." iMEGA has until the end of September to file its case in the Third Circuit Court of Appeals, which is a court historically supportive of First Amendment rights like those iMEGA is arguing.
