Kahnawake Tells Kentucky: Domain Seizure is 'Not Acceptable'

Grand Chief Michael Ahríhrhon Delisle, Jr. of the Mohawk Council of Kahnawake expressed his great disapproval of the Kentucky District Cour's order to seize 141 online poker and Internet gambling domains in a strongly worded letter to Kentucky Governor Steve Beshear saying, "We are compelled to draw to your attention that your actions will also adversely affect the members of our community - and that is not acceptable."

The September 18, 2008 Order of Seizure, which was requested by lawyers representing the state of Kentucky, directs 141 internet domain names be seized and forfeited to the Commonwealth of Kentucky. The list includes such major online poker sites as Bodog, CakePoker, Full Tilt Poker, Ultimate Bet, and PokerStars, and also includes a number of licensees of the Kahnawake Gaming Commission (KGC).

"This is a perfect example of someone who knows nothing about the effects of their actions," said Grand Chief Delisle, "It's not the first time that a government has tried to prevent us from conducting business and it won't be the last. But, rest assured, we will always protect our jurisdiction and the integrity of the Kahnawake Gaming Commission."

October 15 Ruling Coming, Status Quo Till Then

The domain issue awaits the October 15 ruling of Judge Thomas Wingate of the Franklin Circuit Court, who asked for a week to consider his verdict after the October 7 hearing where he heard legal arguments from opposing parties. Legal teams representing online gambling operators and interested parties with standing such included the Poker Players Alliance (PPA), Interactive Gaming Council (IGC), GoDaddy domain registrar and the Interactive Media Entertainment & Gaming Association (iMEGA) as well as lawyers representing individual sites.

Judge Wingate ruled that until his decision on the legality of the Kentucky move has been issued, no interference with the operation of the sites whose domains are in question can occur.

A spokesman for the Grand Chief said further action by the Mohawk Council of Kahnawake to protect Kahnawake's interests will be considered depending on the judge's ruling.
