Kentucky Online Gambling Domain Name Seizure Hearing- Now Friday 3:30pm ETFri, Sep 26th, 2008 @ 12:00am The hearing to determine whether Kentucky Governor Steve Beshear can take control of 141 online poker and internet gambling domains has been postponed until today, Friday September 26, at 3:30pm ET, according to a statement released by Jennifer Brislin, the Communications Director for the Justice and Public Safety Cabinet for the Commonwealth of Kentucky. Those domain names include such online poker sites as: AbsolutePoker.com, Bodoglife.com, Cakepoker.com, Doylesroom.com, Fulltiltpoker.com, and PokerStars.com. Since none of these poker sites are believed to use US-based domain services, all of those sites remained accessible with no interruption in service. Only two minor, non-poker domains that are believed to have been serviced by US-based registrar service ENOM: luckypyramidcasino.com and highrollerslounge.com are known to have been affected. No reason was given for the hearing's delay. The Franklin County Circuit Court hearing, which is the next step in a lawsuit filed by the Justice and Public Safety Cabinet on behalf of the Commonwealth of Kentucky against illegal online gambling sites, was originally scheduled for Thursday afternoon. Based on evidence at a hearing last week, on September 18th, the court found that probable cause did exist to believe that the domain names in question were being used in connection with illegal gambling within the Commonwealth of Kentucky. So the Friday hearing will determine if forfeiture of those domains will be required. WHY FORFEITURE? All gambling, apart from the state lottery and betting on horse races, is prohibited in Kentucky. The state's law also says that any gambling device or gambling record possessed or used in violation of the law is forfeited to the state. Some observers have commented that the move to seize the internet gambling domains is to bolster forms of gambling that contribute to Kentucky's state coffers, which has lagged as more people choose the convenience of online gaming. It was noted that Oregon-based TwinSpires.com, which allows online wagering in horse racing, as advertised by the Churchill Downs Company (host to the Kentucky Derby), is NOT amongst the 141 internet gambling domains listed to seize. The Interactive Media Entertainment & Gaming Association (iMEGA), which was granted legal standing in the US Courts, was in Kentucky Wednesday evening and prepared to challenge the commonwealth on behalf of its industry members. According to gambling911, the million plus member Poker Players Alliance (PPA) and its President, John Pappas, has opted to work with a foreign organization, the Internet Gaming Counsel (IGC), which has no legal standing in the US legal system, rather than working with iMEGA.
