Proposal Due from USA Could End Antigua's 5-year WTO Online Poker Internet Gambling Dispute

Mark Mendel, Antigua and Barbuda's attorney in the World Trade Organization (WTO) dispute against the United States for blocking foreign online poker and Internet gambling operators from the American gaming market, told the Antigua Sun this week that a settlement proposal from the U.S. due by the end of this month could end their five-year trade dispute.

"I am assuming that if they are going to be good to their word, that they will have a proposal. It will be either a proposal or no proposal by the end of the month," Mendel was quoted saying in the article.

The Lawyer indicated that the dual Caribbean island nation of Antigua and Barbuda is adopting a 'wait and see approach' to the proposal, and indicated that it expects that any proposal they agree on will cover the two separate issues involved in the dispute.

THE TWO ISSUES TO COVER

The first issue stems from the United States denying Antigua's Internet gaming operators access to the US gaming market, which WTO ruled was against the General Agreement on Trade in Services (GATS) that the US had signed. A WTO Dispute Settlement Body arbitrator last December awarded Antigua $21 million in sanctions against the USA for the US breaking their GATS treaty (click here for related article).

The second and yet unsettled issue is the compensation Antigua and Barbuda is due under WTO rules which were triggered by the U.S. reacting to WTO's rulings by withdrawing online gaming from their GATS commitments, rather than complying with them.

Antigua and Barbuda was one of several countries to file compensation claims after the US stated their intention to withdraw online gaming from GATS, but Mendel claimed in a previous interview with the SUN that the US had stopped efforts to negotiate on the issue in December 2007. So they filed a notice at the WTO at the end of January requesting arbitration on the issue (click here for related article).

"Any settlement that we would do would be comprehensive. It would take in everything," Mendel explained.

"These are (two separate issues) if we have to litigate them, but if we can settle something then it should all be settled in one go."
