Remote Gaming Association Vows to Continue Fight for Access to US Online Gambling Market

Only days after being disappointed by the World Trade Organization (WTO) online gambling settlement between the United States (US) and the European Union (EU), the Remote Gaming Association (RGA) is filing a formal complaint against the US for its discriminatory practices, reports The Times Online this week.

Referring to repeated rulings by the World Trade Organization that the US violated WTO treaties as well as passage of the Unlawful Internet Gambling Enforcement Act (UIGEA) by the USA, the RGA says that the US Department of Justice violated international trade law by kicking their members out of the market and then taking legal action against offshore operators while allowing domestic online gambling companies to continue operating.

The Department of Justice has subsequently threatened, arrested and carried out legal action against European firms and their representatives.

"How would US investors and businessmen feel if they invested in a business in the UK based on international law commitments, and then suddenly the UK not only passed new laws forcing them to shut down their business but tried to throw them in jail for past activities, while still allowing their domestic competitors to continue on doing the same thing?" Clive Hawkswood, the chief executive of the RGA, remarked.

"We have been left with no choice but to pursue all legal avenues available to challenge the US Department of Justice for its discriminatory enforcement activities against European online gaming operators," Hawkswood added.

The group has asked the EU to investigate the situation, arguing that though the US has repeatedly stated that all forms of online gambling are illegal, it has enforced this view only with non-US businesses.

On Monday a trade compensation agreement was announced between the EU and the US to allow European companies access to the US postal market and warehouse sector as compensation for the lack of access to gaming it pulled gaming out of its WTO trade agreements (click here for related article).

The European gambling industry had hoped that the EU could convince the US to allow them back into the lucrative US online gambling market.

Although the WTO agreement deal provided the EU compensation, it did not deal with the legal side of the dispute, the RGA claims.
