Swedish Papers to Get Day in Court Over Gambling Ads

by PokerPages.com
Sat, Feb 9th, 2008 @ 12:00am

The Swedish Supreme Court has ordered the country's Court of Appeal to test the compatibility of the country's lottery law with existing European law, which is great news to Swedish daily newspapers Aftonbladet and Expressen which have been battling for years to overturn a District Court ruling which bars them from accepting foreign gaming ads, including those for online poker.

The ruling by the Supreme Court means the Court of Appeal must hear the case against the newspapers, according to reports in Gaming Intelligence Group.

Mid January, editors from both papers sent an open letter to EU Internal Markets Commissioner Charlie McCreevy, calling for the European Commission to intervene to stop the attacks by the Swedish government and state gaming monopolies that attempt to force them to NOT accept ads from EU-based online gambling companies who compete with the state gambling monopoly Svenske Spel. In their letter, the editors claim such practices breach Articles 12, 43, and 49 of the EC treaty.

On January 31, the European Commission (EC) began legal action against Sweden and Germany, challenging their protectionist practices against foreign gambling operators, to bring them into compliance with EU directives giving EU-based operators (particularly in the fields of poker, lottery and sports betting) free movement of goods and services between the 27 EU member countries.
